Returns and refunds

This policy applies to every order placed with KAK LARNEY. It is written to comply with the Consumer Protection Act 68 of 2008 (CPA) and the Electronic Communications and Transactions Act 25 of 2002 (ECTA). Where anything below gives you less than those Acts do, the Acts win.

You have three separate rights

People usually lump these together. They are different, they have different time limits, and different people pay the return shipping. Read the one that applies to you.

Right A — you changed your mind (7 days). Section 44 of ECTA gives you a cooling-off period. You may cancel for any reason, or none, within 7 days of receiving the goods. You do not have to explain yourself and we may not charge a penalty. The shirt must come back unworn, unwashed, with tags attached. You pay to send it back. We refund the full purchase price including the original delivery charge, within 30 days of cancellation.

We do not claim the “custom-made goods” exemption. Section 42(2) of ECTA removes this right for goods made to a consumer’s own specification. Our shirts are printed to order, but the designs are our own fixed catalogue and you specify nothing except your size. We therefore treat every order as covered.

Right B — the shirt is defective (6 months). Sections 55 and 56 of the CPA give you an implied warranty of quality. For 6 months from delivery, if a shirt is defective, unsafe, of poor quality, or fails in normal use, you may return it and choose a repair, a replacement, or a full refund. The choice is yours, not ours. These returns are at our risk and our expense — we arrange and pay for collection, charge no handling fee, and do not require the original packaging.

Defects include print that cracks, peels or washes out under normal care, seams that fail, holes, and colour materially different from the product page. The unworn-and-unwashed condition in Right A does not apply here: a defect that only appears after a wash is still a defect.

Right C — we sent the wrong thing. Wrong size, wrong design, wrong colour, or a missing item: tell us and we fix it at our cost, immediately. You do not need to invoke any Act for this one.

Our own size-swap promise

Separately from the law, and because sizing is the thing people get wrong most often, you have 30 days from delivery to swap a shirt for a different size. It must be unworn, unwashed and undamaged. You pay to send it to us, we pay to send the replacement out. This is voluntary, it is more generous than the 7-day cooling-off period, and it does not reduce any right above.

What we cannot take back

Under Right A and the size-swap promise only, we cannot accept a shirt that has been worn, washed, altered or damaged after delivery, or that returns without tags. That is the ordinary condition of a change-of-mind return.

None of this applies to a defective shirt. We will not use the condition of a garment to refuse a legitimate defect claim, and any term that tried to do so would be void under section 51 of the CPA.

How to start a return

Email kak.larney@gmail.com with your order number and what went wrong. A photograph helps for a defect. We reply within one working day with the return address and, where we are paying, the collection arrangement. Keep your proof of postage. Please do not post anything back before you have heard from us, because we cannot match an unexpected parcel to an order.

Refunds

Refunds go back to the original payment method. We process them within 5 working days of receiving and checking the returned shirt, and always within the 30 days ECTA requires. How long the money then takes to appear depends on your bank, which is outside our control.

If you ask for a cash refund rather than a credit or exchange, you get a cash refund. We do not issue store credit in place of a refund unless you choose it.

If we cannot agree

Email us first, because almost everything is solved there. If it is not, you may refer the matter to the National Consumer Commission or to a provincial consumer affairs office, and we will co-operate with either. Nothing in this policy requires you to give up that right, and nothing in it limits your rights under the CPA, ECTA or any other law.
